Terms of Service

CONTRACT AND OVERVIEW

1. These Terms of Service govern the conditions under which you may access and use the Fasdeli Remittance website, application, and services. By accessing, registering, and using the services, you agree to be bound by these Terms of Service. If you do not wish to be bound by these Terms, you may not access, register for, or use the services. In the event of any changes to these Terms of Service, you will be notified, and such changes will not take effect immediately.

2. These Terms of Service take effect upon your first access, registration, or use of the services. The Terms may be amended from time to time; however, any changes will only take effect two (2) weeks after you receive the updated Terms of Service.

3. The term “we”, “our”, or “us” in these Terms refers to Fasdeli Remittance, a non-bank financial company in Indonesia.

4. The term “you” refers to users and visitors of the Fasdeli Remittance website and application.

5. For your security, we recommend that you only send money to individuals you know and trust. All fees displayed and charged are in accordance with principles of fairness and applicable legal regulations.

6. We contract only with the User. We are not liable to any third party, including the payment recipient. If you are dissatisfied with our service, please contact our Customer Support, and we will address your concern promptly.

7. We will make every reasonable effort to deliver your money on time. However, delays may occur due to the following circumstances:
   a) Compliance with Anti-Money Laundering (AML) and Counter-Terrorism Financing (CTF) regulations;
   b) Withdrawal instructions concerning your transaction;
   c) Payments made after our cut-off times;
   d) Downtime caused by partners, internal systems, payout channels, or other parties;
   e) Incorrect transaction details provided; and
   f) Non-operational days (e.g., public holidays).

OUR OBLIGATIONS

1. You acknowledge that the services may not be fully or partially available in certain regions, countries, or jurisdictions. Currently, we only support remittances from Indonesia to other countries.
2. While we will make every effort to provide access to our website or application, we do not guarantee uninterrupted access due to potential technical or unforeseen issues.
3. For compliance purposes, we reserve the right to decline or refrain from processing certain transactions or to limit transaction amounts. We will promptly notify you if such action occurs.
4. We will process transactions promptly; however, some may be delayed or canceled to verify identification, attempt contact, comply with legal requirements, or due to operational changes.
5. We may send transaction-related notifications via email, messages, or other relevant communication channels. We will also provide updated information through our website or application.

YOUR OBLIGATIONS

1. To register and use our services, you must be at least 18 years old and legally capable of entering into binding agreements under your local laws.
2. You must not impersonate any person or entity, commit fraud, or attempt to conceal your identity.
3. You agree to pay us applicable service fees and other related charges in addition to the transaction amount. Unless otherwise stated in these Terms or the Refund Policy, service fees are non-refundable.
4. When registering and using our services, you must provide:
   (a) accurate personal or transaction information;
   (b) updates to your personal information if changes occur;
   (c) details of at least one valid payment instrument (e.g., bank account or debit card); and
   (d) any other identification documents we may require.
5. You are advised to use Fasdeli Remittance solely to send money to people you know. If you choose to pay third parties for goods or services through Fasdeli Remittance, you acknowledge that we have no control over and bear no responsibility for the quality, safety, or delivery of such products or services. However, we will make reasonable efforts to assist you with the transaction.
6. You and the recipient must act for personal purposes only and may not send or receive transactions on behalf of third parties.
7. You must not operate as a remittance company or provide remittance services using Fasdeli Remittance unless you hold a valid remittance license.
8. You must comply with these Terms, as well as all applicable laws and regulations. You must not use our services for illegal activities, including but not limited to money laundering, fraud, or terrorist financing.
9. You must not:
   (a) create more than one registration without our prior written consent;
   (b) allow others to access your registration details;
   (c) refuse to confirm or verify information you have provided; or
   (d) use anonymous proxies or tools intended to conceal your activity on our website or app.
   

OUR RIGHT TO REFUSE, FREEZE, SUSPEND, OR CANCEL

1. For legal and compliance reasons, we reserve the right to refuse, freeze, or suspend any verification, transaction request, payment request, or ongoing transaction at any time.
2. If we refuse, freeze, or cancel a transaction or payment request, we may temporarily or permanently suspend your registration.
3. In such cases, we retain the right to collect any applicable service fees already incurred.
4. We may request additional information or evidence about the purpose of a transaction to comply with legal obligations.
5. We may modify or terminate any part of the services at any time without prior notice.
6. We reserve the right to remit your funds to the relevant authorities upon lawful request.

YOUR RIGHT TO CANCEL OR REQUEST A REFUND

1. Once we have received transaction instructions, you do not have an automatic right to cancel. Cancellation may be possible if you notify us, but some payments may already be processed and non-reversible. In such cases, we may still charge a reasonable cancellation fee.
2. If you encounter issues while using our services or identify unauthorized transactions, please report them within seven (7) days of the transaction date. Refund requests must be submitted through the application, or via email if unavailable, including your full name, address, phone number, transaction tracking number, amount, and reason for refund.
3. You acknowledge and agree that you are responsible for any loss resulting from unauthorized use of the services if such loss results from your fraud or negligence. You agree to indemnify Fasdeli Remittance and its affiliates against all related claims or losses. However, we will make reasonable efforts to issue refunds in cases of negligence and may charge applicable processing fees. Refunds will be credited to the same payment instrument and currency used for the transaction.

DATA COLLECTION

1. Customer Identification Program.
   All financial institutions in Indonesia are required by Anti–Money Laundering (AML) regulations to cooperate in combating money laundering and terrorism financing by collecting and verifying the identity information of all customers. This requirement is also clearly stated in our Anti–Money Laundering Policy. Accordingly, we are legally permitted to obtain information about you and your recipient from various other sources.
2. Verification and Checks.
   To validate your identification, we will verify your personal information and, if necessary, the recipient’s information. All information you provide will be kept confidential and secure. By accepting these Terms of Service, you authorize us to perform necessary validations to verify such information. You must provide honest and accurate information in response to our requests.
   
3. Data Privacy Policy.
   You agree that we may use your personal information for verification purposes. You also consent to our use of your data for communication, legal compliance, accounting, and record-keeping purposes, in accordance with the Fasdeli Remittance Privacy Policy. By doing so, you acknowledge that you have read and accepted our Privacy Policy.
   
4. Government-Mandated Disclosure.
   As stated in our Data Privacy Policy, we may be legally required to disclose your information, service usage, or instructions to governmental or competent authorities. You acknowledge and agree to such disclosures. Please note that we will not share your information for any reason other than those specified in these Terms of Service.

INTELLECTUAL PROPERTY RIGHTS

The Fasdeli Remittance website, application, and services, including all intellectual property rights—such as copyrights, patents, database rights, trademarks, and service marks—are owned by us, our affiliates, or, in certain cases, by third parties.

WARRANTIES AND LIABILITIES

1. If we are found to have breached these Terms resulting in a loss to the user, we will make reasonable efforts to refund the transaction amount and related service fees.
2. Any compensation or claim you make must be supported by relevant documentation.
3. If you suffer a loss not covered under clause 2, our total liability shall be limited to:
   (a) the amount of the service fee; and
   (b) up to IDR 1,000,000, unless otherwise agreed in writing.
   Our liability is limited to losses arising from a single transaction or related series of transactions. For example, if you suffer losses from two unrelated transactions, your total claim may not exceed IDR 2,000,000.
4. In processing your transactions, we shall not be liable for:
   a) any failure to execute services (including your instructions) due to extraordinary or unforeseeable circumstances, or communication failures beyond our control;
   b) any errors on the website, application, or service caused by you or by third parties providing incomplete or incorrect information to us.
5. You agree that no Fasdeli Remittance affiliate or employee has any personal interest in any services provided to you. All such affiliates and employees act solely as representatives of Fasdeli Remittance, and the services are provided strictly on an “as-is” basis.

USE OF THE APPLICATION

1. We grant you a non-exclusive, non-transferable license to use our website or application, subject to your compliance with these Terms of Service, the Privacy Policy, and applicable application requirements (including those incorporated herein by reference), as may be updated from time to time. All rights are reserved to us.
   
2. You agree that, unless expressly permitted by these Terms or applicable law, you shall not:
   a) duplicate the website or application (except for backup or security purposes); or
   b) rent, sublicense, lend, edit, translate, combine, adapt, modify, or otherwise alter the website or application.
3. You understand that the website and application are not tailored to your individual requirements. No warranties or conditions of any kind are given regarding their suitability. You are responsible for ensuring that the features and functions of the website or application meet your needs.
4. We shall not be responsible for any loss or damage suffered by you or any third party arising from delays or reasonable refusals to execute transactions under these Terms, particularly in connection with AML compliance.
5. Upon account opening, you are required to accept the refund terms.
6. Refunds will be made to your primary bank account. Any loss due to undelivered or misdirected funds resulting from your error or issues with your account shall not be our responsibility; however, we will make reasonable efforts to assist you.
7. Refunds can only be made for amounts exceeding IDR 10,000 (ten thousand rupiah).
8. In connection with your use of the website or application, we shall not be liable, to the extent permitted by law, for:
   a) any failure to perform services or delay in message transmission due to circumstances beyond our control or legal obligations;
   b) damage or disruption to communication facilities outside our control that may affect the accuracy or timeliness of messages exchanged;
   c) errors in the application or service caused by incomplete or inaccurate information provided by you or third parties;
   d) any loss or damage resulting from your use of the application on a “jailbroken,” “rooted,” or otherwise modified device.

ELECTRONIC COMMUNICATIONS

1. You acknowledge that these Terms of Service are digitally accepted, and the following categories of information (“Communications”) may be provided electronically:
   a. these Terms of Service, including any amendments or additions;
   b. your records (e.g., transactions) through the services;
   c. any disclosures or notices relating to the services, including those required by law;
   d. communications with Customer Support, including regarding claims or   unauthorized use; and
   e. any other communications related to Fasdeli Remittance services.
   
2. You must promptly notify us of any changes to your email address or phone number by updating your profile at www.fasremit.com.
   To provide optimal service, identity verification and transaction reviews may be conducted daily, including on public holidays. Accordingly, you consent to being contacted by us when necessary. If you object, please inform our Customer Support team.

TERMINATION OF SERVICE

1. We may immediately terminate these Terms and our services if you:
   a) become insolvent or we reasonably believe you are likely to do so;
   b) breach any provision of these Terms;
   c) use the service in a manner that disrupts other users or may damage our reputation;
   d) breach or attempt to breach the security of the site (including, without limitation, unauthorized access, alteration, deletion, interference, reverse engineering, spamming, hacking, or introducing malicious software); or
   e) in our reasonable belief, use the service for fraudulent, illegal, or unethical activities, or allow third parties to do so.
   
2. You may close your account through the Fasdeli Remittance application or website. Before closing your account, please note:
   a) all vouchers and affiliate balances (if any) will be forfeited upon closure;
   b) ensure that no transactions, refunds, or withdrawals are pending; and
   c) closing one account will not affect the status of any other accounts you may hold.

COMPLAINTS

1. If you have any questions or complaints regarding Fasdeli Remittance services, please send them to the address listed on our website or by email to [email protected].
2. We will acknowledge receipt of your inquiry or complaint within one (1) business day. Within five (5) to twenty (20) business days, we will investigate and provide an update or resolution regarding your concern.

GENERAL PROVISIONS

1. Governing Law.
   This Agreement shall be governed by and construed in accordance with the laws of Indonesia. The parties submit to the exclusive jurisdiction of the Indonesian courts.
2. No Waiver.
   Failure by Fasdeli Remittance to enforce any right or provision of these Terms shall not constitute a waiver of such right or provision.
3. Modifications.
   We may amend these Terms from time to time and notify you accordingly, provided such changes do not violate any law. You may review the latest version at any time on our website. If you continue using the services after the effective date of any amendment, you are deemed to have accepted the changes. Any attempt by you to modify these Terms shall be void.
4. Entire Agreement.
   Unless otherwise mutually agreed, this Agreement constitutes the entire understanding between the parties and supersedes all prior agreements regarding the subject matter. By using our services, you agree that this clause is binding under Article 1338 of the Indonesian Civil Code.
5. Severability.
   If any provision of these Terms is deemed invalid by an arbitrator or court of competent jurisdiction, the remaining provisions shall remain in full force and effect.
6. Language.
   These Terms are written in both Indonesian and English. In the event of any inconsistency, the English version shall prevail.
7. Third-Party Links.
   External links to third-party websites are provided for your convenience. We do not control, and are not responsible for, the accuracy, completeness, legality, or content of such websites. Accessing them is at your own risk.
8. Intellectual Property Rights.
   By using our services, we grant you the right to use them solely in accordance with these Terms. All elements of the website and application, including all components of the services (“Intellectual Property”), are owned by us and/or our licensors and are protected under applicable copyright and trademark laws.

SECURITY

At Fasdeli Remittance, we take security extremely seriously and strive to ensure that your information remains protected. Fasdeli Remittance allows you to send money online to friends, family, business partners, and trusted individuals. However, we strongly advise you to exercise caution when sending money to unknown persons. Offers that appear “too good to be true” should be treated with skepticism, as they may be fraudulent.
If you receive any suspicious or “phishing” emails claiming to be from Fasdeli Remittance, please forward them to our Customer Support team immediately.
